Terms of Use

These terms form an agreement between you and Harbourside Apps Pty Ltd ("Harbourside Apps", "we", "us" or "our") for your use of Offset and related services. By using Offset, you agree to these terms. If you do not agree, do not use Offset.

What Offset does

Offset creates personal travel plans using your selected flight schedule, usual sleep pattern and planning choices. Plans may include suggested times for sleep, light, caffeine and, only when you opt in, melatonin. Some features depend on network access, notifications, Apple services or third-party flight information.

Safety

• Use your judgment and follow current advice from qualified health professionals.
• Do not follow sleep or light guidance when doing so would be unsafe, including while driving, operating equipment or when you must remain alert.
• Caffeine and melatonin may not be suitable for everyone. Check the product label and seek professional advice, especially if you are pregnant, breastfeeding, under medical care, take medicines, have a sleep condition or have had an adverse reaction.
• Do not delay urgent care because of information in Offset.

Flight information and plans

Flight times and status come from third parties and may be late, incomplete or wrong. Offset is not an airline, airport, travel agent or booking service. Always check your booking and official airline or airport information. Offset does not guarantee that it will detect a delay, cancellation, gate change or itinerary change.

Plans are estimates based on the information available and the choices you provide. Results vary between people, and we do not promise that a plan will prevent jet lag, improve sleep or produce a particular outcome. If information changes or you miss a step, use your judgment and check the latest plan in the app.

Using Offset

You agree that you will:

• Give accurate information where it affects your plan or account recovery.
• Keep your device and linked sign-in methods secure.
• Use Offset only for lawful, personal purposes.
• Not misuse, disrupt, scrape or try to gain unauthorised access to Offset or its services.
• Not copy, reverse engineer or resell Offset except where law expressly permits it.

Users and sign-in

Offset creates an anonymous user on your installation so you can start without signing in. You may add Sign in with Apple or Google for recovery and cross-device use. You are responsible for activity under your user and for keeping linked provider access secure.

If you are not old enough to make this agreement where you live, a parent or guardian must agree for you. Offset is not intended for children under 13.

Free use and Pro subscriptions

Offset has a free Manual mode. The first eligible Journey includes complimentary Pro delivery; this is not an auto-renewing free trial and does not require payment. Paid Pro is offered as a weekly or annual auto-renewing subscription. The app shows the current local price and billing period before purchase. Prices may vary by country and may change as Apple permits.

• Apple bills subscriptions to your App Store account when you confirm purchase.
• Weekly and annual subscriptions renew automatically until cancelled.
• Apple may charge for renewal within 24 hours before the current subscription period ends.
• Manage or cancel in iOS Settings under your Apple Account and Subscriptions. Cancelling usually leaves access in place until the paid period ends.
• Apple handles billing disputes and refund requests under its rules.
• Family Sharing is subject to Apple's rules. Each family member keeps a separate Offset user, profile and journeys.

Deleting your Offset user does not cancel an Apple subscription. Cancel it separately through Apple if you do not want it to renew.

Availability and changes

We may add, change, suspend or remove a feature, or limit access where needed for safety, security, law, maintenance or service operation. We do not guarantee uninterrupted or error-free access. We will avoid taking away paid access without a valid reason and will respect rights that consumer law gives you.

Intellectual property

Harbourside Apps and its licensors own Offset, its software, design, content and branding. These terms give you a limited, personal, revocable and non-transferable right to use Offset on Apple devices you own or control, subject to Apple's usage rules.

Apple terms

Apple's Standard Licensed Application End User License Agreement also applies to the app license. Harbourside Apps, not Apple, is responsible for Offset and its support, subject to the rights and duties in Apple's standard agreement.

Ending use and deletion

You may stop using Offset at any time and may permanently delete your user in the app. We may suspend or end access if you materially breach these terms, create a security risk, misuse the service or if law requires it. Sections intended to continue after termination, including intellectual property and liability terms, will continue.

Consumer guarantees and liability

Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including under the Australian Consumer Law. Subject to those rights, Offset is provided on an "as is" and "as available" basis. To the fullest extent law permits, we exclude implied warranties and are not liable for indirect or consequential loss, lost travel, missed flights, lost profits or lost data arising from your use of or reliance on Offset.

Where the law lets us limit liability for a service guarantee, our liability is limited, at our choice, to supplying the service again or paying the cost of having it supplied again.

Changes to these terms

We may update these terms. We will post the new terms with a new effective date and give added notice where a change is material. If you continue to use Offset after the new terms take effect, you accept them. If you do not agree, stop using Offset and cancel any subscription.

Governing law

The laws of New South Wales, Australia govern these terms. You and Harbourside Apps submit to the courts of New South Wales and courts that may hear appeals from them. This does not remove any mandatory rights you have under the law where you live.
